• Register or create an account with, access, visit, or otherwise use (collectively, “interact”) the website www.porterpros.com (our “Website”).
• Download, install, or interact with the Porter Pros, LTD mobile application (our “App”).
• Make purchases through our Website or App (collectively referred to herein as our “Services”).
• Become one of our vehicle transport drivers (each a “Driver” and collectively, the “Drivers”).
• Email, text, call, or otherwise communicate with us.
This Policy describes our practices for collecting, using, maintaining, protecting, and disclosing your information. This Policy does not apply to information that:
• We collect offline or on any other applications or websites, including content you may access through our Services.
• You provide to, or that is collected by, any third party (see Third-Party Information Collection).
Please read this Policy carefully to understand our policies and practices regarding your information and how we will treat it. If you do not agree with our policies and practices, do not interact with our Services in any way, whether as a user, consumer, or Driver. By interacting with our Services, you agree to this Policy. This Policy may change from time to time (see Changes to Our Privacy Policy). Your continued use of our Services after we revise this Policy means you accept those changes, so please check this Policy periodically for updates.

CHILDREN UNDER THE AGE OF 18

Our Services are not intended for children under 18 years of age. No one under age 18 may provide any information to or on our Services. We do not knowingly collect personal information from children under 18. If you are under 18, do not use or provide any information on our Services, or, through any of its features, register on our Services, make any purchases through our Services, use any of the interactive or public comment features of our Services, or provide any information about yourself to us, including your name, address, telephone number, email address, or any screen name or user name you may use. If we learn we have collected or received personal information from a child under 18, we will delete that information. – Register or create an account with, access, visit, or otherwise use www.porterpros.com (our “Website”).

– Download, install, access, or use the Porter Pros mobile application (our “App”).

– Request, schedule, purchase, provide, or participate in vehicle transportation, maintenance, or related services through our Website or App.

– Become, apply to become, or act as one of our vehicle transport drivers (each a “Driver”).

– Email, text, call, or otherwise communicate with us.

The Website, App, and related services are collectively referred to in this Policy as the “Services.”

Please read this Policy carefully to understand our practices regarding your information and how we treat it. If you do not agree with this Policy, do not use the Services.

CHILDREN UNDER THE AGE OF 18

Our Services are not intended for children under 18 years of age. We do not knowingly collect personal information from children under 18. If we learn that we have collected or received personal information from a child under 18, we will delete that information. INFORMATION WE COLLECT

We collect information from and about customers, Drivers, Driver applicants, affiliated businesses, Website visitors, and other users of the Services. This information may include:

– Contact and account information, such as name, postal address, email address, telephone number, username, password, and account preferences.

– Identity and eligibility information, such as date of birth, driver’s license or state identification information, employment information, Driver application information, and, for Drivers where required, tax or social security information.

– Trip and service information, such as pickup location, drop-off location, service location, route information, vehicle information, trip status, trip history, customer instructions, and communications between customers, Drivers, affiliated businesses, and Porter Pros.

– Payment and transaction information, such as billing details, payment method information, transaction records, service charges, tips, refunds, and payout information. Payment information may be processed by our payment service providers.

– Communications and support information, such as messages, emails, calls, texts, reviews, incident reports, support requests, and related records.

– Photos, videos, audio, documents, and other files that you choose to upload or capture through the App, such as profile photos, vehicle photos, vehicle documents, driver documents, media shared in chats, or trip-related documentation.

– Device and usage information, such as IP address, device identifiers, browser type, operating system, mobile network information, App usage, logs, crash data, pages or screens viewed, links clicked, and other information about how you interact with the Services.

– Location Data, as described in the “Location Data” section below.

HOW WE COLLECT INFORMATION

We collect information:

– Directly from you when you provide it to us, including when you create an account, request a service, apply to become a Driver, upload documents or media, contact support, complete forms, submit reviews, or communicate through the Services.

– Automatically when you use the Website or App, including through cookies, logs, analytics tools, device permissions, and similar technologies.

– From third parties, such as affiliated businesses, service providers, payment processors, mapping and navigation providers, analytics providers, fraud prevention providers, and business partners.

LOCATION DATA

The Porter Pros App accesses, collects, uses, and shares Location Data to provide vehicle transportation, maintenance, navigation, trip coordination, and real-time trip tracking features.

“Location Data” means information about the location of your device or trip, including approximate location, precise GPS location, latitude and longitude, route information, pickup and drop-off locations, service locations, Driver movement during a trip, timestamps associated with location updates, and location-derived information such as distance, route progress, estimated arrival, and trip status.

The App may collect Location Data in the following ways:

– Customers: When you use location-based features, the App may collect your current location or the locations you enter for pickup, drop-off, dealership, maintenance, or other service points.

– Drivers: When you are using the App as a Driver, the App may collect your precise real-time location while you are viewing available jobs, navigating to a pickup, service, dealership, or drop-off location, performing an active trip, or otherwise using trip-related Driver features.

– Background Driver Location: For Drivers, the App may collect precise real-time location while the App is in the background during an active trip or while an active trip resumes after the App restarts. This background location collection is used to provide continuous trip tracking, navigation support, route progress, ETA updates, and customer/member visibility into the Driver’s progress on the map. Background Driver location tracking is intended to run only for active trip-related workflows and stops when the active tracking workflow ends, the trip is completed or canceled, tracking is stopped, or the Driver logs out.

– Device Location Services: Location Data may be collected using GPS, Wi-Fi, Bluetooth, cellular signal, device sensors, maps, and other location technologies made available by your device operating system.

We use Location Data to:

– Create, schedule, coordinate, and fulfill vehicle transportation and maintenance service trips.

– Show pickup, drop-off, dealership, service, and other trip locations on maps.

– Help Drivers navigate to pickup, drop-off, dealership, service, and other trip destinations.

– Let customers, members, affiliated businesses, and Porter Pros personnel track Driver progress during active trips.

– Provide real-time trip status, estimated arrival, route progress, and distance calculations.

– Match Drivers with relevant jobs or nearby trip opportunities.

– Confirm trip activity, arrival, pickup, service, drop-off, completion, and related trip events.

– Send operational notifications related to trips, Driver progress, arrival, delays, or service updates.

– Provide customer support, investigate incidents, resolve disputes, improve safety, prevent fraud, and maintain trip records.

– Maintain, troubleshoot, analyze, and improve the Services.

We may disclose Location Data:

– To customers, Drivers, affiliated businesses, and Porter Pros personnel involved in an active or scheduled trip, so they can coordinate service and track trip progress.

– To mapping, navigation, hosting, database, analytics, notification, support, payment, fraud prevention, and other service providers that help us operate the Services.

– To comply with applicable law, legal process, or governmental requests.

– To protect the rights, property, or safety of Porter Pros, users, Drivers, affiliated businesses, or others.

– In connection with a merger, acquisition, financing, restructuring, sale of assets, or similar business transaction.

– With your consent or at your direction.

You can control App location access through your device settings. If you disable Location Data, some features may not work. For customers, this may limit trip scheduling, map, tracking, or service coordination features. For Drivers, disabling foreground or background location may prevent you from accepting jobs, navigating trips, sharing trip progress, or completing active Driver workflows.

We do not use precise Location Data collected by the App for third-party interest-based advertising.

We collect several types of information from and about you, including information:
• By which you may be personally identified, such as your name, postal address, email address, telephone number, date of birth, driver’s license or state identification card, and other information by which you may be personally identifiable (“personal information”). For Drivers, this includes, among other things, your social security number and your employment information and history.
• That is about you, but individually does not identify you.
• About your internet connection, the equipment you use to access our Services, and other usage details.
We collect this information:
• Directly from you when you provide it to us, such as when you fill in an account registration form or Driver application form.
• Automatically from you when you use our Services, such as, your device’s operating system and other usage details (see Automatic Information Collection).
• From third parties, for example, our business partners and affiliates.

Information You Provide to Us

The information we collect on or through our Services includes:
• Information that you provide at the time of signing up for our newsletters and email correspondences, registering with or logging in to our Services, purchasing and scheduling vehicle transportation and/or maintenance services, applying to become one of our Drivers, posting reviews or otherwise uploading materials (“User Contributions”), and corresponding with us (such as when you request further information or seek resolution of an issue).
• Records and copies of your correspondences with us (whether you are a general user, customer, or Driver), including correspondences between customers and Drivers.
• Your responses to surveys that we might ask you to complete for research purposes.
• Details of your transactions with us that you carry out on or through our Services, and the fulfillment of your orders. This requires providing financial information to us.
• Your search queries on our Services.
• Your location data (if you are a customer or a Driver).
Depending on how you choose to interact with our App, we may also access your device’s camera, photo library, address book. At your direction, this may include collecting photos, audio clips, videos, and/or personal contact information.
Automatic Information Collection and Tracking

When you interact with our Services, we may use technology to automatically collect your:
• Usage Data. When you interact with our Services, we may automatically collect certain details of your access to and use of our Services, including traffic data, location data, logs, and other communication data and the resources that you access and use on or through our Services.
• Device Information. We may collect information about your device and internet connection, including your device’s unique device identifier, internet protocol (“IP”) address, operating system, browser type, mobile network information, and the device’s telephone number.
• Stored Information and Files. Our Services may access metadata and other information associated with other files stored on your device. This may include, photos, videos, audio clips, personal contracts, and other information from your device’s camera, photo library, and personal address book.
• Location Information. Our Services may collect real-time information about the location of your device. For our customers and Drivers, this location information is precise and can pinpoint your location to within a 1,850-foot radius.
The technologies and third-party tools we use for automatic information collection include:

• Cookies (or mobile cookies). A cookie is a small file placed on your smartphone or on the hard drive of your computer. You may refuse to accept browser cookies by activating the appropriate setting on your smartphone or browser. However, if you select this setting you may be unable to access certain parts of our Services. Unless you have adjusted your settings so that it will refuse cookies, our system will issue cookies when you direct your browser to our Website or when you use our App.
• Flash Cookies (or local shared objects). A flash cookie is a data file that can be created on your computer by the sites you visit. Unlike regular web cookies, which can be disabled via your browser preferences, you can only disable flash cookies by adjusting the settings of your flash player to block flash cookie storage (for example, Adobe Flash Player Settings Manager). Please note that setting your flash player to restrict or limit acceptance of flash cookies may reduce or impede the functionality of some flash applications, including flash applications we use within our Services.
• Web Beacons. Pages of our Services and our emails may contain small electronic files known as web beacons (also referred to as clear gifs, pixel tags, and single-pixel gifs) that permit us to, for example, count users who have visited a page or opened an email and for other related website statistics (for example, recording the popularity of certain content and verifying system and server integrity).
• Click Tracking. We use click tracking technologies to analyze user interaction with our Website. These technologies may record information such as the time and date of your visit, the pages you viewed, and the links you clicked. We use this information to optimize and personalize your experience, better market and advertise, and otherwise improve our Services.
• Google Analytics. We use a tool called “Google Analytics” to collect information about use of our Website. Google Analytics collects information such as how often users visit our Website, what pages they visit when they do so, and what other sites they used prior to coming to our Website. We use the information we get from Google Analytics only to improve our Website. Google Analytics collects only the IP address assigned to you on the date you visit our Website, rather than your name or other identifying information. We do not combine the information collected through the use of Google Analytics with personally identifiable information. Although Google Analytics plants a permanent cookie on your web browser to identify you as a unique user the next time you visit our Website, the cookie cannot be used by anyone but Google. Google’s ability to use and share information collected by Google Analytics about your visits to this site is restricted by Google Analytics’ Terms of Use and Google’s Privacy Policy. When you use our Services, certain third parties may use any number of these or other automatic information collection technologies to collect information about you or your device. These third parties may include:
• Advertisers, ad networks, and ad servers.
• Hosting service providers.
• Credit card and gift card processors.
• Analytics companies.
• Your mobile device manufacturer.
• Your mobile service provider.
• Email marketing service providers.
These third parties may use tracking technologies to collect information about you when you use our Services. The information they collect may be associated with your personal information or they may collect information, including personal information, about your online activities over time and across different websites, apps, and other online services websites. They may use this information to provide you with interest-based (behavioral) advertising or other targeted content.

We do not control these third parties’ tracking technologies or how they may be used. How We Use Your Information

We use information that we collect about you or that you provide to us, including any personal information, to:
• Provide you with our Services and their contents, and any other information, products, or services that you request from us.
• To improve the effectiveness of our services, and marketing communications.
• To measure or understand the effectiveness of the advertising we deliver to you and others, and to deliver relevant advertising to you.
• Fulfill any other purpose for which you provide it.
• Give you notices about your account.
• Carry out our obligations and enforce our rights arising from any contracts entered into between you and us, including for billing and collection.
• Notify you when App updates are available, and of changes to any products or services we offer or provide though our Services.
The usage information we collect helps us to improve our Services and to deliver a better and more personalized experience by enabling us to:
• Estimate our audience size and usage patterns.
• Store information about your preferences, allowing us to customize our Services according to your individual interests.
• Speed up your searches.
• Recognize you when you use our Services.
We use location information we collect to coordinate vehicle transportation and/or maintenance service trips between customers, Drivers, and affiliated businesses who performing maintenance services (or who are otherwise acting as a drop-off point for the customer’s vehicle).

We may also use your information to contact you about our own and third parties’ related goods and services that may be of interest to you. If you do not want us to use your information in this way, please see Your Choices About Our Collection, Use, and Disclosure of Your Information.

We may use the information we collect to display advertisements to our advertisers’ target audiences. If you click on or otherwise interact with an advertisement, the advertiser may assume that you meet its target criteria.

HOW WE DISCLOSE YOUR INFORMATION

We may disclose aggregated information about our users, and information that does not identify any individual or device, without restriction.

In addition, we may disclose personal information that we collect or you provide:
• To our subsidiaries and affiliates.
• To contractors, service providers, and other third parties we use to support our business and who are bound by contractual obligations to keep personal information confidential and use it only for the purposes for which we disclose it to them.
• To a buyer or other successor in the event of a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of the Company’s assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which personal information held by the Company about our Services’ users is among the assets transferred.

• To create consumer profiles reflecting a person’s preferences, characteristics, psychological trends, predispositions, behavior, attitudes, intelligence, abilities, and/or aptitudes.
• To analyze auto maintenance trends.
• To fulfill the purpose for which you provide it.
• For any other purpose disclosed by us when you provide the information.
• With your consent.
• To comply with any court order, law, or legal process, including to respond to any government or regulatory request.

• If we believe disclosure is necessary or appropriate to protect the rights, property, or safety of the Company, our customers, or others. This may include exchanging information with other companies and organizations for the purposes of fraud protection and credit risk reduction.
YOUR CHOICES ABOUT OUR COLLECTION, USE, AND DISCLOSURE OF YOUR INFORMATION

We strive to provide you with choices regarding the personal information you provide to us. This section describes mechanisms we provide for you to control certain uses and disclosures of your information.

• Tracking Technologies. You can set your browser to refuse all or some browser cookies, or to alert you when cookies are being sent. If you disable or refuse cookies or block the use of other tracking technologies, some parts of our Services may then be inaccessible or not function properly. Other ways to opt-out of specific data collection technologies that we utilize include:
o Google Analytics. Google has a browser add-on for opting out of Google Analytics which can be found here: https://tools.google.com/dlpage/gaoptout.
• Location Information. You can choose whether or not to allow our App to collect and use real-time information about your device’s location through your device’s privacy settings. If you block the use of location information, you will not be able to engage with our vehicle transportation and/or maintenance services as a customer or Driver.
• Promotion by the Company. If you do not want us to use your personal information to promote our own or third parties’ products or services, you can opt-out by selecting “unsubscribe” in our promotional emails, [OTHER METHODS].
• In-App Notifications. We may occasionally send you notifications through both in-App alerts and phone notifications to enhance your user experience and keep you information about important updates, promotions, or relevant context. You can adjust your notification preferences by accessing your settings within the App or through your phone settings.
• SMS Communications. By providing your mobile phone number and using our mobile application, you consent to receiving SMS messages from us. We may use SMS communications to provide you with important updates, account information, or promotional offers related to our services. You can opt-out of these communications at any time by following the instructions provided in the SMS messages or by adjusting your notification preferences in the App settings. Please note that standard messaging and data rates may apply depending on your mobile carrier plan.
• Targeted Advertising by the Company. If you do not want us to use information that we collect or that you provide to us to deliver advertisements according to our advertisers’ target-audience preferences, you can opt-out by stating your request to info@porterpros.com.
• Disclosure of Your Information for Third-Party Advertising and Marketing. If you do not want us to share your personal information with unaffiliated or non-agent third parties for advertising and marketing purposes, you can opt-out by emailing us stating your request to, info@porterpors.com. You can also always opt-out by [logging into the App and adjusting your user preferences in your account profile by checking or unchecking the relevant boxes or] by sending us an email [or text message] stating your request to info@porterpros.com.
• User Contributions. Your User Contributions are displayed on public areas of our Services, which are posted and transmitted at your own risk. Please be aware that no security measures are perfect or impenetrable. We cannot control the actions of third parties who interact with your User Contributions on or through our Services. We cannot and do not guarantee that your User Contributions or interactions with other users will not be viewed by persons with whom you do not wish to share your User Contributions.
We do not control third parties’ collection or use of your information to serve interest-based advertising. However, these third parties may provide you with ways to choose not to have your information collected or used in this way. You can opt out of receiving targeted ads from members of the Network Advertising Initiative (“NAI”) on the NAI’s website.

ACCESSING, CORRECTING, AND DELETING YOUR PERSONAL INFORMATION

You may update, amend, or delete your information at any time by signing in to your account, if you have one, and visiting the account settings section that allows you to manage your personal information. You may also send us an email at info@porterpros.com to request access to, correct, or delete personal information that you have provided to us. We cannot delete your personal information except by also deleting your user account. We may not accommodate a request to change information if we believe the change would violate any law or legal requirement or cause the information to be incorrect.

If you delete your User Contributions, copies may remain viewable in cached and archived pages, or might have been copied or stored by other users. YOUR STATE PRIVACY RIGHTS

[California’s “Shine the Light” law (Civil Code Section § 1798.83) permits users of our Services that are California residents to request certain information regarding our disclosure of personal information to third parties for their direct marketing purposes. State consumer privacy laws may provide their residents with additional rights regarding our use of their personal information. For example, California, Colorado, Connecticut, Virginia, and Utah each provide their state residents with, among others, rights to access and delete certain personal information, and to receive personal data that they have provided in a structured, commonly used and machine readable format. California, Colorado, Connecticut, and Virginia also provide their state residents with, among others, rights to correct inaccuracies in their personal information, taking into account the information’s nature and processing purpose.

DATA SECURITY

The security of your personal information is important to us. While we have implemented measures designed to secure your personal information from accidental loss and from unauthorized access, use, alteration, and disclosure, no method of transmission over the Internet, or method of electronic storage is 100% secure.

The safety and security of your information also depends on you. Where you have a password for access to certain parts of our Services, you are responsible for keeping this password confidential. We ask you not to share your password with anyone and urge you to be careful about giving out information in public areas.

Although we do our best to protect your personal information, we cannot guarantee the security of your personal information transmitted through our Services. Any transmission of personal information is at your own risk. We are not responsible for circumvention of any privacy settings or security measures we provide.

CHANGES TO THIS POLICY

We may revise update this Policy from time to time. All changes are effective immediately when posted, and apply to all access and use of our Services thereafter. Your continued use of our Services following the posting of the Policy as revised means that you accept and agree to the changes. You are expected to check this Policy frequently so you are aware of any changes, as they are binding on you. If you are dissatisfied with our Services, its content or our Policy (including as modified), you agree that your sole and exclusive remedy is to discontinue using our Services.
